GENERAL TERMS AND CONDITIONS OF THE SITE AND THE “BUFFALO WILD WINGS REWARDS” LOYALTY PROGRAM

1. ACCEPTANCE OF THE TERMS AND CONDITIONS

These Terms and Conditions (hereinafter, the “Terms”) govern the use of all our online interfaces and properties, including our websites, mobile applications, and the loyalty program known as “Buffalo Wild Wings Rewards” (collectively, the “Site”). The Site is owned and operated in Mexico by WILD WINGS, S.A. DE C.V. (hereinafter, “BWW Mexico”).

By accessing or using this Site in any manner, you (hereinafter, the “User”) agree to and are bound by these Terms in their entirety. If you do not agree with these Terms, you must refrain from using the Site.

BWW Mexico reserves the right to modify these Terms at any time by posting the changes on the Site and indicating the date of the last update. The User’s continued use of the Site after such modifications constitutes tacit acceptance of the updated Terms.

Eligibility: The Site and its services are available exclusively to individuals over 18 years of age who have the legal capacity to enter into binding obligations.

2. PRIVACY NOTICE AND PERSONAL DATA PROTECTION

BWW Mexico, with its address at [Blvd. Antonio L. Rodríguez No. 3000, Interior Floor 20, Col. Santa María, Monterrey, N.L., Mexico], is responsible for the processing of your personal data. The processing of the personal data provided by the User will be carried out in accordance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP) and its regulations.

3. “BUFFALO WILD WINGS REWARDS” LOYALTY PROGRAM

A. Enrollment and General Information:

  • Participation in the program is free of charge and is offered at the discretion of BWW Mexico.
  • To enroll, the User must create an account on the Site or on the BWW Mexico mobile application, providing the requested information, which must be truthful, complete, and up to date.
  • The program is exclusive to natural persons. Registration by companies, organizations, or any other corporate entities is not permitted.

B. Point Accumulation:

  • Program members (the “Members”) will earn 1 (one) point for every $10.00 MXN spent on Qualified Purchases, before taxes, tips, and other charges.
  • “Qualified Purchases” include all food and non-alcoholic beverages purchased at participating locations in Mexico, whether directly at the restaurant or through orders placed on the Site or the BWW application.
  • Points are not earned on the purchase or reload of gift cards, merchandise, donations, alcoholic beverages, or orders placed through third-party delivery platforms (Uber Eats, Didi Food, Rappi).
  • A point accumulation limit is established of a maximum of two (2) purchases per day and seven (7) purchases within a consecutive seven (7)-day period.

C. Boosted Status:

  • Members who accumulate a minimum spend of $4,000.00 MXN in Qualified Purchases during a calendar year (from January 1 to December 31) will achieve “Boosted Status.”
  • Members with Blazin’ Status will earn 1.2 (one point two) points for every $10.00 MXN spent.
  • The status will be maintained for the remainder of the calendar year in which it is achieved and throughout the entire following calendar year.

D. Redemption and Validity of Points and Rewards:

  • Accumulated points may be redeemed for selected BWW menu items available in the “Rewards Catalog” within the Site.
  • Points have no monetary value, are non-transferable, and cannot be redeemed for cash.
  • Rewards redeemed from the menu will be valid for ninety (90) days from the redemption date for use. After this period, the reward will expire and cannot be reactivated.
  • Points accumulated in a Member’s account will expire and be removed if no Qualified Purchase is made for a period of six (6) consecutive months

4. REWARDS SHOP

  • Method of Payment: The only form of payment accepted in the Rewards Shop is program points.
  • Shipping: Shipping of physical merchandise is available only within the United Mexican States.
  • Cancellations and Returns: All redemption transactions are final. No changes or cancellations are permitted once an order has been processed. If an item arrives damaged or is incorrect, the User must contact customer service via email at [___________] to request a refund of the corresponding points to their account. Replacement of the item is not guaranteed and will be subject to inventory availability.

5. SITE USE AND INTELLECTUAL PROPERTY

  • Intellectual Property: All content on the Site, including trademarks, logos, text, and images, is the exclusive property of BWW and its licensors and is protected by the Federal Copyright Law and the Industrial Property Law. Reproduction, imitation, or use for commercial purposes without prior express written authorization is prohibited.
  • Use Restrictions: The User agrees not to use the Site for unlawful purposes, unauthorized commercial activities, or to transmit viruses or malicious code. The use of automated means (robots, spiders, etc.) to extract information from the Site is also prohibited.

6. ACCOUNT RESPONSIBILITY

The User is solely responsible for maintaining the confidentiality of their username and password, as well as for all activities that occur under their account. The User must immediately notify BWW Mexico of any unauthorized use of their account.

7. LIMITATION OF LIABILITY

BWW Mexico will make reasonable efforts to keep the Site operational and free from errors. However, the Site is provided “as is” and “as available.” BWW Mexico shall not be liable for service failures, interruptions, or for any direct or indirect damages resulting from the use of or inability to use the Site, except in cases where applicable law prohibits such limitation. In any event, BWW Mexico’s liability shall be limited to what is established under the Federal Consumer Protection Law.

8. GOVERNING LAW AND JURISDICTION

For the interpretation, compliance, and enforcement of these Terms, the parties expressly submit to the federal laws in force in the United Mexican States.

For any dispute, the parties agree to first submit to the administrative jurisdiction of the Federal Consumer Protection Agency (PROFECO). If the dispute persists, the parties submit to the jurisdiction of the competent courts of Monterrey City, Nuevo León, expressly waiving any other jurisdiction that may apply due to their present or future domiciles.
